Open Air Burning Ban
By-Law O-103 Update

The Halifax Regional Council is in the process of passing By-Law O-103 to ban Open Air Fires in HRM.

The by-law was proposed to address the concerns of fire safety and reduce or eliminate airborne polutants.

HOW THIS AFFECTS YOU

Kingswood sub-division is OUTSIDE THE NO BURN ZONE but the new by-law O-103 still affects us. The following summary, taken from the By-Law, indicates the impact to our residents...

Brush Fires;

  • No brush fires are allowed within 225 feet of the nearest dwelling outside the no burn zone. (Councilor Reg Rankin is fighting for a reduction to 100 feet but, he needs our help...use the instructions below to send your comments to the Halifax Regional Municipality councilors).

Outdoor wood burning Appliances;

  • Manufacturer's installation instructions must be followed.

  • Must not be placed on wood decks or combustible platforms.
  • Only dry seasoned firewood shall be burned (no smoke by-products)
  • Must be a minimum of 15 feet away from any other combustible materials.
  • Must no be used when the Dept of Natural Resources have implemented the summer ban on open air fires.
  • Only one outdoor burning appliance to be used at one time per property.
  • The appliance must be constructed of non-combustable materials.

Campfires;

  • Must be contained by non-combustible material to prevent spread of fire.

  • Must not exceed 24" diameter or 18" height (wood).
  • Only dry seasoned firewood shall be burned (no smoke by-products)
  • Must be a minimum of 15 feet away from any other combustible materials.
  • Must no be used when the Dept of Natural Resources have implemented the summer ban on open air fires.
  • Only one campfire to be operating at one time per property.

Burn Permits;

  • Burn permits are required for all outdoor fires as per Department of Natural Resources regulations. CLICK HERE to find out how to get your burn permit.

  • Fires for bbq, with grates, or other cooking devices do not require a permit.

COUNCILOR RANKIN NEEDS OUR HELP (PRO OR CON)

To voice your opinion regarding the whether to reduce the proximity limitations from 225 feet to 100 feet from the nearest dwelling, Councilor Rankin has suggested sending an e-mail to the clerk's office for distribution to council. The address is clerks@region.halifax.ns.ca.

The Kingswood Ratepayers Association neither supports or opposes the ban on open air fires as the community response has been mixed on the issue. The Board encourages the residents to form their own opinions and send e-mail to the councilors at the address mentioned above to let their concerns be known.
